On Thursday, the 3rd day of May, in Cascade, Dubuque County, Iowa, Mrs. Johanna Wagener nee Theisen died after a long illness from dropsey. The deceased was born 78 years ago in the Grand Duchy of Luxembourg and settled after her arrival in the United States, first in St. Donatus, Jackson Co., Iowa where she married Martin Wagner. The couple lived on a farm near Cascade for many years. After her husband died Mrs. Wagner retired and settled in Cascade. She is survived by the following children: Mrs. Peter Rink of East Dubuque, Ill; Mrs. Nikolaus Sauber and Mrs. Susanna Zimmer of Lakeville, Minn.; Mrs. Anna Hoffman of LaMotte. Iowa; Mrs. Michael Rink and Nikolaus Wagner of Cascade and Philipp Wagner of remson, Iowa.

Know all men by these presents: THAT, I, Johanna Eagener, widow, of the Town of Cascade in the County of Dubuque and State of Iowa, considering the uncertainty of this life, and being of sound mind and memory, do make, publish and declare this my last will and testament hereby revoking all former wills made by me at any time heretofore.
I.
I hereby direct that all my just debts shall first be paid out of my estate.
II.
I give and bequeath to my son, John Wagener, the sum of one hundred dollars, which amount I desire him to use as stipends for masses to be procured to be read in St. Mary's Church, at Cascade, Iowa, for my intention.
III.
I give and bequeath to my son, John Wagener, all my household furniture and domestic effects.
IV.
I hereby direct that the amounts hereinafter bequeathed to my son, Nicholas Wagener, shall be paid to and recieved by my son, John Wagener, in trust for the said Nicholas Wagener and that the monies so recieved shall be invested by the said John Wagener for the benefit of the said Nicholas Wagener, and from the said monies, and the income arising from the investment of the same, the said John Wagener shall, when by him deemed necessary, provide for the support and care in sickness of the said Nicholas Wagener, so long as any of said monies remain unexpended in his hands.
V.
I give and bequeath to my daughter Anna Hoffman, $300.00;
To my Son Nicholas Wagener $200.00 (to be recieved and administered in trust by John Wagener as provided in paragraph IV hereof);
To my daughter, Catherine Sauber, $300.00;
To my son, Philip Wagener (two hundred Dollars) $200.00;
To my daughter Mary Rink, $300.00;
To my daughter, Susanna Zimmer, $300.00;
and to my daughter, Theresia Rink $300.00;
which amounts are to be paid to the said respective legatees wihtin one year after my deaty by my son, John Wagener, as provided in the next following paragraph hereof.
VI.
I give and devise to my son, John Wagener, my real estate, consisting of THE NORTH EAST QUARTER OF THE NORTH EAST QUARTER OF SECTION THIRTY-FIVE (35): THE NORTH WEST QUARTER OF THE NORTHWEST QUARTER OF SECTION THIRTY-SIX (36) AND THE SOUTH EAST QUARTER OF THE SOUTH EAST QUARTER OF SECTION TWENTY-FIVE (25) IN TOWNSHIP EIGHTY-SIX (86) NORTH, RANGE TWO (2) WEST OF THE 5TH P.M. in Jones County, Iowa, to have and to hold to him upon payment by him of the sums mentioned and bequeathed in the preceeding (5th) paragraph hereof, to the legatees in said paragraph named, and at the time and in the manner therein provided. (note - this adds up to 240 acres of land)
VII.
I give, devise and bequeath the residue of my estate as follows, to wit: the one-ninth part thereof to my Son, Nicholas Wagener, to be recieved and administered in trust by John Wagener as provided in paragraph IV hereof;
The one-ninth part thereof to the children of my deceased daughter, Elizabeth Gehlen;
The one-ninth part thereof to my son, Philip Wagener;
The one-ninth part thereof to my Daughter, Catherine Sauber;
The one-ninth part thereof to my daughter, Mary Rink;
The one-ninth part thereof to my daughter Susanna Zimmer;
The one-ninth part thereof to my Daughter, Theresia Rink;
The one-ninth part thereof to my son, John Wagener;
The one-ninth part thereof to my Daughter, Anna Hoffman.
VIII.
I hereby nominate and appoint my son John Wagener, to be the executor of this my last will and testament, without bonds.

Now on this 2nd day of July 1906 came on for hearing the application of John Wagener praying that he be appointed executor of the above intitled estate. It appears from said application that Johanna Wagener, late of Dubuque County, Iowa, departed this life in said county on or about the 3rd day of May A.D. 1906, leaving a will, which has been duly admitted to probate in said court.
That the said deceased was at the time of her death a widow, and that she left surviving her the following devisees and legatees, to wit:

That decendent died seized of the following real estate, to wit:
The Souht East Quarter of the South West Quarter of Section Twenty-five (25) the North east quarter of the north east quarter of section thirty-five (35) and the North west quarter of the north west quarter of section thirty-six (36), all in township Eighty-six (86) north, Range two (2) West in Jones County, Iowa. and also personal property of about the value of thirteen hundred dollars.
That the value of said estate (undiminished by debts) does not exceed the sum of four thousand eight hundred ($4800.00) dollars. That there are no debts or claims against said estate remaining unpaid. Your petioner, John Wagener, who was named in said will as executor, without bonds, therefor, respectfully prays that letters testamentary may be granted unto him. And the court having examined said application, and deeming John Wagener to be a fit and proper person to act as such executor, said John Wagener is therefor appointed Executor of said estate without bond and he is ordered to publish notice of his appointment in the Cascade Pioneer once a week for three weeks.
INVENTORY
On the second day of July 1906 the Executor of the above estate filed an inventory of the personal property in the above estate showing the same to consist of Household furniture bequeathed to in full to executor and of little value. Cash on hand at time of decease $50.00, accounty with Cascade Bank amounting to $1264.26.
